[RECAP] WORKSHOP: “EXPEDITED PROCEDURES IN RESOLVING CHAIN DISPUTES AND PRACTICE IN COMMERCIAL DISPUTE RESOLUTION”

📌 Ngày 26/3/2026, Hội thảo chuyên đề “Thủ tục rút gọn trong giải quyết tranh chấp chuỗi và thực tiễn tranh chấp kinh doanh thương mại” thuộc khuôn khổ Chuỗi Hội thảo chuyên đề và Diễn đàn Khoa học Trọng tài – Hòa giải 2026 (AMS 2026) đã diễn ra thành công tốt đẹp. Hội thảo do Trung tâm Trọng tài Quốc tế Việt Nam (VIAC) phối hợp cùng Trường Đại học Kinh tế – Luật, Đại học Quốc gia TP. Hồ Chí Minh và Trường Đại học Luật – Đại học Quốc gia Hà Nội (VNU-UL) tổ chức, với sự tham gia của nhiều chuyên gia uy tín trong lĩnh vực pháp lý và giải quyết tranh chấp. Hội thảo thu hút hơn 200 đại biểu tham dự tại hai điểm cầu song song Hà Nội và TP. Hồ Chí Minh.
📌 Hội thảo bao gồm 02 phiên thảo luận. Trong đó, Phiên thảo luận 1 với nội dung “Thủ tục rút gọn trong tranh chấp chuỗi: Đặc thù, điểm khác biệt và lưu ý khi áp dụng” được điều phối bởi TS. Đào Gia Phúc – Viện trưởng Viện Pháp luật Quốc tế và So sánh, Trường Đại học Kinh tế – Luật, Đại học Quốc gia TP. Hồ Chí Minh. Trong đó, phiên thảo luận 1 tập trung làm rõ các đặc thù của thủ tục rút gọn trong bối cảnh tranh chấp chuỗi, đồng thời làm rõ những điểm khác biệt trong cách tiếp cận và các lưu ý quan trọng khi áp dụng cơ chế này trong thực tiễn giải quyết tranh chấp.
📌 Phiên thảo luận 2 với chủ đề “Áp dụng thủ tục rút gọn trong quản trị tranh chấp kinh doanh thương mại dạng chuỗi” được điều phối bởi PGS. TS. Nguyễn Bích Thảo – Quyền Chủ nhiệm Khoa Luật tư, Trường Đại học Luật – Đại học Quốc gia Hà Nội (VNU-UL). Phiên 2 có sự tham gia của PGS.TS. Võ Trí Hảo – Chuyên gia, Viện Pháp luật Quốc tế và So sánh, Trường Đại học Kinh tế – Luật (UEL), ĐHQG-HCM. Một số nội dung thảo luận bao gồm: (i) Đặc thù tranh chấp kinh doanh thương mại và khả năng áp dụng thủ tục rút gọn cho chuỗi tranh chấp; (ii) Một số điểm mới trong quy tắc VIAC về thủ tục rút gọn và định hướng áp dụng với tranh chấp dạng chuỗi; Thực tiễn vận dụng thủ tục rút gọn trong chuỗi tranh chấp kinh doanh thương mại: Góc nhìn từ VIAC và liên hệ thực tiễn quốc tế; (iii) Khuyến nghị các chuỗi giao dịch/hợp đồng áp dụng thủ tục rút gọn và cách thức thỏa thuận quy trình thủ tục rút gọn.
📌 Tại Hội thảo, Trường Đại học Kinh tế – Luật (UEL) và Trung tâm Trọng tài Quốc tế Việt Nam (VIAC) đã tiến hành Lễ ký kết Thỏa thuận hợp tác. Theo đó, nội dung hợp tác tập trung vào các hoạt động như:
⭐️ Phối hợp triển khai các chương trình đào tạo ngắn hạn;
⭐️Tham gia hỗ trợ giảng dạy các chương trình ngoại khóa và các hoạt động đào tạo trong lĩnh vực trọng tài và hòa giải thương mại;
⭐️ Xây dựng và tổ chức các chương trình kiến tập, thực tập dành cho sinh viên khối ngành luật;
⭐️ Phối hợp tổ chức hội thảo, hội nghị, tọa đàm chuyên đề và các hoạt động học thuật liên quan.
⭐️ Thống nhất hợp tác xây dựng mô hình Trung tâm Trọng tài thương mại.
Biên bản ghi nhớ có hiệu lực trong thời hạn 02 năm, với kỳ vọng mở rộng cơ hội hợp tác và phát triển bền vững cho cả hai đơn vị.

📌 On 26 March 2026, the specialized workshop entitled “Expedited Procedures in Resolving Chain Disputes and Practice in Commercial Dispute Resolution”, held within the framework of the Arbitration – Mediation Symposium 2026 (AMS 2026), was successfully conducted.
The workshop was co-organized by the Vietnam International Arbitration Centre (VIAC), the VNU University of Economics and Law (UEL), and the VNU University of Law (VNU-UL) with the participation of numerous distinguished experts in the field of law and dispute resolution. The event attracted more than 200 participants across two simultaneous venues in Hanoi and Ho Chi Minh City.
📌 The workshop consisted of two panel sessions.
Panel Session 1, titled “Expedited Procedures in Chain Disputes: Characteristics, Distinctions, and Practical Considerations”, was moderated by Dao Gia Phuc, Managing Director of the Institute of International and Comparative Law, UEL. This session focused on clarifying the distinctive features of expedited procedures in the context of chain disputes, as well as highlighting key differences in approaches and important considerations in their practical application.
📌 Panel Session 2, titled “Application of Expedited Procedures in Managing Commercial Chain Disputes”, was moderated by Nguyen Bich Thao, Acting Dean of the Faculty of Private Law, VNU-UL.
The session featured the participation of Vo Tri Hao, expert at the Institute of International and Comparative Law, UEL. Key discussion topics included:
(i) The characteristics of commercial business disputes and the applicability of expedited procedures to chain disputes;
(ii) Certain new developments in the VIAC Rules on expedited procedures and their orientation for application to chain disputes; the practical application of expedited procedures in commercial chain disputes: perspectives from VIAC and references to international practice;
(iii) Recommendations on transaction/contract chains suitable for expedited procedures and methods for agreeing on expedited procedural processes.
📌 During the workshop, the University of Economics and Law (UEL) and the Vietnam International Arbitration Centre (VIAC) held a signing ceremony for a Memorandum of Understanding (MoU).
The cooperation focuses on:
⭐️ Jointly implementing short-term training programs;
⭐️ Supporting teaching activities in extracurricular and professional training programs in arbitration and commercial mediation;
⭐️ Developing internship and practicum programs for law students;
⭐️ Co-organizing conferences, seminars, workshops, and other academic activities.
⭐️ Establishing a model of a Commercial Arbitration Center.
The MoU will be effective for a period of two years, with the expectation of expanding cooperation opportunities and fostering sustainable development for both institutions.
