[TỔNG KẾT] PHIÊN TÒA GIẢ ĐỊNH: TRANH CHẤP VỀ XẢ THẢI GÂY THIỆT HẠI ĐẾN SINH KẾ NGƯỜI DÂN

Vào hai ngày 5/01/2024 và ngày 10/01/2024, Trường Đại học Kinh tế – Luật, ĐHQG-HCM do Viện Pháp luật Quốc tế và So sánh làm đầu mối đã lần lượt tổ chức 02 phiên tòa giả định thuộc khuôn khổ dự án “Tăng cường năng lực tiếp cận công lý môi trường cho các nhóm yếu thế sống phụ thuộc vào rừng trên địa bàn TP.HCM” cho người dân là hộ nghèo sống phụ thuộc vào rừng tại xã An Thới Đông và xã Tam Thôn Hiệp, huyện Cần Giờ, TP.HCM. Đặc biệt, phiên tòa vào ngày 10/01/2024 có sự hiện diện của đại diện Bộ Tư Pháp, Bộ Nội Vụ, đại diện phái đoàn EU và Ban thư ký Quỹ EU JULE JIFF tại Việt Nam. Đoàn đại biểu đã trao đổi thảo luận trực tiếp cùng người dân, cán bộ địa phương. Tình tiết Phiên Tòa giả định liên quan đến tranh chấp về hành vi xả thải gây thiệt hại đến sinh kế người dân. Cụ thể, cuối tháng 2 cho tới giữa tháng 3/2023 các trại nuôi nghêu của 15 hộ dân tại địa phương đồng loạt chết khoảng 80%. Nguyên nhân ban đầu được xác định là do hành vi xả thải của Công ty TNHH thép Khang Hy gây ra biến động về môi trường nuôi trồng. Nội dung của phiên tòa giả định đề cập đến các quyền liên quan đến môi trường của người dân do hành vi xả thải gây ô nhiễm môi trường tạo ra, cụ thể là quyền yêu cầu chủ thể gây ô nhiễm bồi thường thiệt hại. Mục đích để người dân biết được các trình tự, thủ tục giải quyết yêu cầu bồi thường thiệt hại đối với tài sản, sức khoẻ của người dân bị ảnh hưởng do hành vi xả thải chưa qua xử lý ra môi trường. Từ đó, nêu cao ý thức trách nhiệm của người dân trong việc bảo vệ môi trường, trách nhiệm của các bên liên quan trong việc đảm bảo quyền liên quan môi trường của người dân. Phiên toà được thực hiện bởi các em sinh viên UEL thuộc Đội hình Tư vấn và Giảng dạy pháp luật cộng đồng, Trường Đại học Kinh tế – Luật (CLE-UEL) dưới sự hướng dẫn của các chuyên gia dự án.—————

[RECAP] MOCK TRIALS: DISPUTES ON WASTEWATER CAUSING DAMAGES TO THE LIVELIHOODS OF FOREST-DEPENDENT PEOPLE
On January 5, 2024, and January 10, 2024, the University of Economics and Law, VNU-HCM, organized two mock trials as part of the project “Strengthening the capacity to access Environmental Justice for vulnerable forest-dependent groups in Ho Chi Minh City.” The mock trials were held for residents, particularly impoverished households dependent on forests, in An Thoi Dong commune and Tam Thon Hiep commune, Can Gio district, Ho Chi Minh City. Notably, the trial on January 10, 2024, saw the presence of representatives from the Ministry of Justice, the Ministry of Home Affairs, the EU delegation, and the EU JULE JIFF Fund in Vietnam. Delegates engaged in direct discussions with residents and officials. The mock trial focused on the dispute over waste discharge causing harm to the livelihoods of residents. Specifically, from late February to mid-March 2023, the clam farming facilities of 15 households in the area experienced a simultaneous 80% mortality rate. The initial cause was identified as the waste discharge practices of the Khang Hy Construction Corporation, leading to environmental disruptions in aquaculture. The content of the mock trial addressed the environmental rights of residents affected by pollution resulting from waste discharge, specifically the right to demand compensation from the polluting entity. The aim was to inform residents about the procedures and processes for seeking compensation for damages to their property and health caused by untreated waste discharge into the environment. Consequently, it aimed to raise awareness of the responsibility of residents in environmental protection and the responsibility of relevant parties in ensuring the environmental rights of the people. The mock trials were conducted by students in Clinical Legal Education, University of Economics and Law (CLE-UEL), and under the guidance of project experts.—————
