📌 On December 1st, 2023, the University of Economics and Law, Viet Nam National University Ho Chi Minh City (UEL), collaborated with the Hanoi Law University (HLU) and University of Law, Hue University (HUL) to organize the international hybrid conference: “Environmental Protection and Climate Change Policies and Law 2023 (EPCCPL 2023): International and National Legislation Reaching Net-Zero Emissions – the Perspective of Developing Countries”. In UEL, the Institute of International and Comparative Law was responsible for the organization of the EPCCPL 2023.
📌 The EPCCPL 2023 was the international hybrid conference organized at UEL (Ho Chi Minh City) with the language used in English. The conference had the participation of 140 international speakers (from the United States, Japan, China, Thailand,…), representatives of state management agencies, scientists, graduate students, etc. .. from universities, institutes, and research centers across the country.
📌 During the plenary session, Prof. Alan R. Palmiter (William T. Wilson, III, Presidential Chair for Business Law, Wake Forest University, US), explored philosophical and religious (Buddhist) perspectives on environmental protection. Meanwhile, Prof. Yuko Nishitani (Vice President of the Hague Academy of International Law, Kyoto University, Japan) discussed climate change through the lens of international public and private law, addressing transparent legal mechanisms for Climate Change Litigation. Additionally, Prof. Yuko Nishitani emphasized the urgency of climate change adaptation, the professor said that “Now or never” to limit global warming to 1.5 degrees and achieve “net-zero” emissions by 2050.
📌 Professor Zhang Hui (Southwest University of Political Science and Law, China) discussed the terms “climate justice” and “climate litigation” presenting China’s legal framework for “Environmental public interest civil litigation” (EPIL). He asserted that low-income communities, colored people, indigenous people, persons with disabilities, the elderly, and even women are vulnerable to the adverse impacts of climate change.
📌 Closing plenary session, Dr. Dao Gia Phuc (Director of the Institute of International and Comparative Law, UEL) provided key trends and developments of carbon pricing globally and Vietnamese policy and law on the carbon market. The choice of which carbon pricing method to use remains a subject requiring further research and clarification, with prominent methods such as Emissions Trading Systems (ETS), carbon tax, carbon credit, and the international carbon market. Dr. Dao Gia Phuc concluded that there is no one-size-fits-all solution, this issue should be determined based on the circumstances, priorities, and needs in Viet Nam.
📌 Furthermore, in 4-panel sessions, nearly 30 presentations were presented by 40 authors (afternoon of December 1st, 2023) around 04 topics: International legislation reaching net-zero emissions; National legislation reaching net-zero emissions; Climate justice and meaningful public participation in environmental decision-making; Climate change, Carbon market, and cross-cuting issues.
📌 In the closing session, Assoc. Prof. Dr. Le Vu Nam expressed that the EPCCPL will become an annual event organized alternately by the three units, providing a platform for scholars from all over the world to collaborate, exchange academic knowledge, and contribute value to society on environmental protection and climate change topics.

📌 Ngày 01/12/2023, Trường Đại học Kinh tế – Luật, ĐHQG-HCM đã phối hợp với Trường Đại học Luật Hà Nội (HLU) và Trường Đại học Luật, Đại học Huế (HUL) tổ chức Hội thảo quốc tế với chủ đề: “Environmental Protection and Climate Change Policies and Law 2023: International and National Legislation Reaching Net-Zero Emissions – the Perspective of Developing Countries”. (EPCCPL 2023). Tại UEL, Viện Pháp luật Quốc tế và So sánh là đơn vị đầu mối tổ chức Hội thảo quốc tế EPCCPL 2023.
📌 Hội thảo EPCCPL 2023 được tổ chức trực tiếp tại Trường Đại học Kinh tế – Luật, ĐHQG – HCM (TP.HCM) kết hợp hình thức trực tuyến với ngôn ngữ sử dụng là tiếng Anh. Hội thảo đã thu hút sự tham gia của 140 diễn giả quốc tế (đến từ Hoa Kỳ, Nhật Bản, Trung Quốc, Thái Lan,…), đại diện các cơ quan quản lý nhà nước, nhà khoa học, nghiên cứu sinh,… từ các trường đại học, viện, trung tâm nghiên cứu trên cả nước.
📌 Tại phiên toàn thể, GS. Alan R. Palmiter William T. Wilson, III, Trưởng Khoa Luật Kinh doanh, Trường Luật, Đại học Wake Forest, Hoa Kỳ gợi mở một số giải pháp để bảo vệ môi trường dưới lăng kính triết học và tôn giáo (phật học) của Phương Đông. Trong khi đó, GS. Yuko Nishitani, Phó Chủ tịch Học viện Luật Quốc tế the Hague, Đại học Kyoto, Nhật Bản đã trình bày chủ đề biến đổi khí hậu từ quan điểm của luật pháp quốc tế công, tư và đề cập đến cơ chế pháp lý minh bạch cho những vụ kiện về môi trường. Thêm vào đó Giáo sư khẳng định việc thích ứng với biến đổi khí hậu cần bắt đầu ngay bây giờ (“Now or never”) nếu muốn hạn chế sự nóng lên toàn cầu ở mức 1,5 độ và đưa mức mức thải ròng về “0” vào năm 2050.
Trong khi đó, trong phần trình bày của mình, GS. Zhang Hui, Trường Đại học Trung Chính Tây Nam, Trung Quốc đã trình bày về thuật ngữ “climate justice” và “climate litigation” (tố tụng môi trường), kinh nghiệm xây dựng văn bản quy phạm pháp luật của Trung Quốc làm cơ sở cho việc khởi kiện dân sự vì lợi ích công cộng về môi trường (được gọi chung là EPIL). Trong đó, Giáo sư khẳng định cộng đồng người có thu nhập thấp, người da màu, người bản địa, người khuyết tật, người già hoặc trẻ em và thậm chí cả phụ nữ đều là đối tượng dễ bị tổn thương trước những tác động tiêu cực của khí hậu, môi trường.
Tại bài tham luận cuối, TS. Đào Gia Phúc, Viện trưởng, Viện Pháp luật Quốc tế và So sánh, UEL đã giới thiệu chung về bối cảnh và khung pháp lý về định giá cacbon tại Việt Nam cũng như xu hướng của Thế giới trong việc định giá cacbon. Hiện nay, vấn đề sử dụng phương pháp định giá carbon nào vẫn là nội dung cần được nghiên cứu, làm rõ, một số phương pháp nổi bật như ETS (Hệ thống trao đổi tín chỉ các-bon), thuế carbon và tín chỉ carbon, và thị trường carbon quốc tế. Tại phần kết luận, TS. Đào Gia Phúc cho rằng không có lựa chọn nào phù hợp cho tất cả – do đó, việc lựa chọn công cụ, mức độ bao phủ và định giá như thế nào nên được quyết định trên cơ sở đáp ứng hoàn cảnh, ưu tiên và nhu cầu tại Việt Nam.
📌 Ngoài ra, Hội thảo còn lắng nghe gần 30 bài tham luận với tham gia 40 tác giả tại 04 phiên chuyên đề (vào buổi chiều cùng ngày), xoay quanh những chủ đề: International legislation reaching net-zero emissions; National legislation reaching net-zero emissions; Climate justice and meaningful public participation in environmental decision-making; Climate change, Carbon market, and cross-cuting issues.
📌 Tại phần phát biểu bế mạc, PGS.TS. Lê Vũ Nam thể hiện mong muốn Hội thảo EPCCPL sẽ trở thành hoạt động thường niên được tổ chức luân phiên giữa 03 đơn vị nhằm tạo cầu nối cho các diễn giả từ khắp các châu lục có thể cùng nhau hợp tác, trao đổi học thuật và đưa ra các đóng góp có giá trị cho xã hội về các chủ đề bảo vệ môi trường và biến đổi khí hậu.
